Copyright, which at best is a complex issue, is currently made even more so by proposed major changes.
- Canada’s Copyright reform bill, Bill C-32, which had gotten past the 2nd hearing in November died when the general election was called in April, 2011 . The bill will have to be renamed and reintroduced and go through the same process as previous bills, a process that could take well into 2012. http://kwantlen.ca/library/services/Copyright.html
- Previous to that, the Copyright Act was in the process of being amended.
- Access Copyright , the Canadian copyright licensing authority for clearing copyright work that Kwantlen holds a license with, has also proposed changes.
Latest Information
On December 23, 2010, the Copyright Board granted Access Copyright’s application for an interim decision by issuing an interim tariff entitled Access Copyright Interim Post-Secondary Educational Institution Tariff, 2011-2013, to commence January 1, 2011. A final decision by the Copyright Board on Access Copyright’s proposed changes will be rendered sometime in the future.
Many institutions, including Kwantlen, have opted to operate under the “interim tariff”. In essence the interim tariff continues the terms and conditions of the existing licence agreements that the Association of Universities and Colleges of Canada (AUCC) members had with Access Copyright.
What does this mean to employees and students of Kwantlen?
Kwantlen can continue making paper copies from January 1, 2011 on, just as it did under the institution’s previous licence with Access Copyright. Kwantlen will continue with the current course manual process through E-Print and the Bookstores.

Please note: at this time the digital copies option has not been elected by Kwantlen nor by most other B.C. postsecondary institutions pending further analysis of cost/benefit ratio and reporting requirements.
Background: Proposed Amendments to the Copyright Act
On June 2, the text to the new copyright bill, Bill C-32 was introduced. There are sections applicable to educators, publishers, and librarians which will be of interest to Kwantlen employees. The government launched a website, Balanced Copyright , that provides information about the proposed legislation. The Backgrounder section of the web site has specific information for educators and librarians.

Use of Electronic Resources Licensed by Kwantlen Polytechnic University Library
The agreements that Kwantlen University negotiates with our database vendors allow use of licensed material for research, instruction, and educational purposes. Commercial use of licensed material is not allowed under the terms of our database licences. Generally the licence terms allow you to print or download a copy of an article for yourself and to post persistent links to journal articles. Posting or scanning articles or book chapters in Moodle or personal web sites is generally not allowable. Remote use to databases or web sites is permissible for current students and employees of Kwantlen. For those not affiliated with Kwantlen, limited onsite access is available.
